1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of temeculalimos.com (the “Website”) and any services, quotes, reservations, purchases, communications, or transactions offered by Temecula Valley Transportation, Inc., doing business as Temecula Limos (“Company,” “we,” “us,” or “our”).

By accessing the Website, requesting a quote, booking a reservation, submitting information, or otherwise engaging with the Company, you agree to be bound by these Terms and by our Reservation and Service Policies, which are incorporated into these Terms by reference. If you do not agree, you must discontinue use immediately.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to book our services or use this Website. By booking, you represent and warrant that you meet these requirements and that you are authorized to act on behalf of every member of your party.

3. Services

The Company provides chauffeured ground transportation in the Temecula Valley and surrounding areas, including wine tours, party bus and lifestyle charters, wedding transportation, cruise and airport transfers, and point to point service.

All services are subject to vehicle availability. We reserve the right to refuse service to anyone for lawful reasons at our sole discretion. Vehicle images shown on the Website are representative of our fleet. The specific vehicle assigned to your reservation is subject to availability, and we reserve the right to substitute a vehicle of equal or greater capacity.

Service descriptions and pricing are subject to change without notice.

4. Quotes, Pricing, and Payment

Quotes are non-binding until a reservation is confirmed and a deposit is received. Rates are quoted per vehicle and are all inclusive, as described in our Reservation and Service Policies. Additional charges may apply based on:

  • Changes to the itinerary, route, or stops requested during service
  • Wait time beyond the scheduled pickup window
  • Hours in excess of the reserved charter time
  • Tolls, parking, venue access fees, and permits
  • Cleaning or damage fees as described in our Reservation and Service Policies

Deposit, balance, and cancellation terms are set out in our Reservation and Service Policies. Securing a reservation with a deposit constitutes agreement to those terms. Failure to make timely payment may result in cancellation of your reservation, late fees, collection action, or additional costs as permitted by law.

5. Reservations, Cancellations, and Refunds

Deposit requirements, payment deadlines, cancellation fees, and refund eligibility are governed by our Reservation and Service Policies, which form part of these Terms. Those terms are presented to you at the time of booking and you accept them when you secure your reservation with a deposit.

Except as stated in those policies or as required by law, completed services are non-refundable.

6. Customer Responsibilities

You agree to:

  • Provide accurate pickup and drop off addresses, contact information, and service times
  • Ensure the number of passengers does not exceed the stated capacity of the reserved vehicle
  • Ensure that all members of your party comply with these Terms and our Reservation and Service Policies
  • Be present and ready at the scheduled pickup time
  • Comply with all applicable laws and regulations during the charter
  • Not misuse or interfere with the Website or our services

The individual who books the reservation is the responsible party and accepts financial responsibility for the conduct of all passengers, including any cleaning fees, damage charges, or overtime charges incurred during the charter. Where any passenger is under 18, the responsible party must be an adult of at least 18 years of age and remains responsible for those passengers throughout the charter.

7. Passenger Conduct and Safety

For the safety of all passengers and in compliance with applicable law:

  • All passengers must remain seated while the vehicle is in motion
  • Alcohol may only be consumed by passengers who are 21 years of age or older, and valid identification may be required. Alcohol may not be consumed by, or provided to, any passenger under 21
  • Illegal substances are prohibited in our vehicles at all times
  • Smoking and vaping are prohibited in our vehicles
  • Standing through a sunroof, hanging out of windows, or any similar conduct is prohibited

Our chauffeurs have full authority to enforce these rules. If a passenger refuses to remain seated, is disruptive, is intoxicated to the point of concern, or refuses to comply with a lawful instruction from the chauffeur, the chauffeur may end the charter immediately. In that event no refund will be issued and the responsible party remains liable for the full reserved amount and for any additional charges incurred.

8. Vehicle Damage and Cleaning

The responsible party is liable for the cost of repairing any damage to the vehicle or its contents caused by any member of the party, and for cleaning fees as set out in our Reservation and Service Policies. Where the vehicle must be removed from service for cleaning or repair, the responsible party may also be liable for lost booking revenue during that period.

9. Personal Property

We are not responsible for personal property that is lost, damaged, or left behind in our vehicles. If an item is recovered we will make reasonable efforts to return it to you, and a delivery or handling charge may apply.

10. Delays, Traffic, and Missed Departures

While we plan routes carefully and monitor conditions, we cannot control traffic, weather, road closures, construction, mechanical failure, or acts of third parties.

We are not liable for delays, missed connections, missed flights, or missed cruise departures caused by circumstances beyond our reasonable control. For airport and cruise transfers, we strongly recommend scheduling your pickup with substantial time in advance of your departure. Our reservations team can advise on recommended pickup times for your specific departure.

11. Communications

By providing your phone number and email address, you consent to receive communications from us relating to your reservation. This includes your quote and confirmation, an email the day before your event containing your chauffeur and dispatch details, and contact from your chauffeur by call or text at the time of pickup. Your phone number is shared with the chauffeur assigned to your trip for this purpose. We do not send automated marketing text messages.

12. Accessible Transportation

Our fleet does not currently include wheelchair accessible vehicles. If you require accessible transportation, please contact us at 951-676-2384 and we will reach out to an affiliate partner on your behalf to source a quote.

13. Prohibited Conduct

You agree not to use the Website for unlawful purposes, interfere with its security features, attempt unauthorized access to systems or data, upload malicious code, or misrepresent your identity. Violation may result in termination of access and legal action.

14. Intellectual Property

All Website content, including text, graphics, logos, images, video, software, and design elements, is the property of Temecula Valley Transportation, Inc. or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent.

15. Limitation of Liability

To the fullest extent permitted by law, Temecula Valley Transportation, Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to use of the Website, delays or interruptions, errors or omissions, or the actions of third parties.

Except as stated in the following paragraph, our total liability for any claim arising from services shall not exceed the amount paid by the customer for the specific service giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, and in those cases our liability is limited to the maximum extent permitted by law.

16. Disclaimer of Warranties

The Website is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy or reliability of information. We do not guarantee uninterrupted or error free operation of the Website.

This disclaimer applies to the Website. It does not limit our obligation to provide transportation services with the care required by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless Temecula Valley Transportation, Inc., its owners, officers, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms, your misuse of the Website, your breach of applicable laws, or the negligence or misconduct of you or any member of your party.

18. Third-Party Services

The Website may contain links to third party websites or integrate third party services, including our booking platform. We are not responsible for the content, privacy practices, or performance of third party services. Your use of third party platforms is at your own risk and subject to their terms.

19. Force Majeure

We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, wildfire, severe weather, government actions, road closures, labor disputes, supply chain disruptions, and utility or system failures.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

The parties agree to attempt to resolve any dispute through good faith negotiation first, and through mediation if negotiation does not resolve it. Any dispute that remains unresolved shall be brought exclusively in the state or federal courts located in Riverside County, California, and both parties consent to the jurisdiction of those courts. Each party shall bear its own legal fees unless otherwise required by law.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Updates will be reflected by revising the “Last Updated” date. Continued use of the Website or services after changes constitutes acceptance of the revised Terms.

23. Entire Agreement

These Terms, together with our Privacy Policy and our Reservation and Service Policies, constitute the entire agreement between you and Temecula Valley Transportation, Inc. regarding use of the Website and our services.
